    Family Sponsorship Visa For Canada

Canadian citizens or permanent residents can sponsor their spouse or conjugal partner, dependent children (including adopted ones), and other eligible relatives (such as parents or grandparents) for Canadian immigration through the Canada family visa. About 25% of about 400,000 Canadian immigrants are planned to be invited through family sponsorships in 2021. Canada family immigration visa is quite a popular visa category after the economic class category.

Who all are covered under 'Other Eligible Relatives' for the Family Visa?

The terms of the Canada family visa clearly state that you can only sponsor your spouse or common-law partner and dependent children living in or outside Canada. Canadian citizens or permanent residents, as well as relatives being sponsored, have to meet all the eligibility requirements. The sponsor also has to take financial responsibility for the family members he/she is sponsoring.

Other relatives eligible to be sponsored under the family class program include parents, grandparents, brothers, sisters, nieces, and nieces. Children adopted outside Canada or ones you intend to adopt in Canada can also be sponsored on the family visa. Grandsons and granddaughters under 18 years of age, who are not married or in a conjugal relationship, and are orphans can also be sponsored as family members.

Who cannot migrate to Canada as a spouse?

Anybody who is under 16 years of age, has been married to someone else at the time of marriage to the sponsor, or has stayed away from his or her sponsor for at least one year and lived as a partner or spouse of another person - is not eligible for family sponsorship to Canada as a spouse, conjugal partner, or common-law partner.

Similarly, if the sponsor has mentioned the person as a family member already at the time of their PR application process, then that person cannot be accepted as a spouse or common-law partner later.

If the sponsor has already sponsored and provided funds for another person as a spouse or CLP within the 3-year period who became the permanent resident, he or she cannot sponsor another person as a spouse or conjugal partner.

In some cases, spouses or partners or dependent children can be allowed to reside in Canada on humanitarian and compassionate grounds even if their sponsors do not meet the eligibility requirements of sponsoring a family member or do not have funds to support them. Benefits of Canada Family Visa

    • Sponsored family members do not have to undergo a points-based evaluation system.
    • If the sponsored family members are granted the Canada PR status, they can live, work, and study in Canada forever.
    • Sponsored family members and relatives can attend language training programs, work unconditionally, and get appropriate help to find the right employment opportunities.
    • These family members or relatives can also access all the benefits and social care programs offered to other permanent residents or citizens of Canada, such as free education until the age of 18, healthcare benefits, subsidized rates of university education, Canada Pension Plan, Old Age Security program, and Guaranteed Income Supplement.
    • Parents who enter Canada on a dependent visa can apply for Canadian citizenship after living in Canada as a permanent resident for three years.

What does a Sponsorship Agreement entail?

In a sponsorship agreement of a family visa, the sponsor accepts that he/she is ready to support his relative or dependent for an agreed period - financially or otherwise - without taking social assistance meant for citizens or permanent residents of Canada.

Sponsored family members, except for elderly relatives, need to ensure that they have access to the required funds to help them settle down in Canada for the first few months.
